Spouse visa to ILR or Extend spouse visa?

Hello,

My wife got two years dependant (wife) visa on 30th June 2006.
She came to the UK on 14th July 2006
and her visa expires on 30th June 2008.

Just a quick question regarding extending spouse visa. If applied within UK is it called FLR (Further Leave to Remain)?

She passed her Life in the UK test last saturday with 100% score. We have PEO appointment on 25th June 2008. I'm hoping for the best but at the same time I want to plan for the worse. What is my fall back position if things doesn't go according to plan on 25th June? Does she have to go back and apply for two year spouse visa from her home country?

Please let me know.

If she initially entered the UK on a spouse visa endorsement, then she may apply for SET(M) between [14 July - 28 days (4 weeks)] and 30 June, i.e. between 16 June and 30 June.

desperado, do you have your 20 documents jointly addressed and spread out around the two year period? If you don't, do make sure that you both have documents that are evenly spread, i.e. don't leave long gaps for either of you.

Worse case is that they give her another 2 year spouse-visa instead of ILR.

Hello Vinny, I'm aware of those dates applying for ILR. What I'm after is, what to do if I cannot provide all the documents they want for ILR? Can I apply for FLR here in the UK or does she have to apply for spouse visa extension back home?

Will the PEO office in croydon give her another 2 year visa? or she have to apply for it back home?

From what I remember of the IDIs, they will give her another 2 year spouse visa on the spot if they can't give ILR. If you don't want to leave anything to chance, look up the relevant section of the IDIs and bring it with you.

If it comes to another spouse visa, she won't need to wait another 2 years and you can reapply for ILR (SET(M)) as soon as you have enough documents.
