Spouse Visa - UK job offer

Post by scarajones » Thu Apr 24, 2014 5:14 am

UK citizen with non EEA spouse - financial requirement can be met with job offer that starts no later than 3 months from date of application.

Anyone know if the job offer has to be permanent full time, or can it be temporary full time (eg) a 1 year contract job?

Thanks

page 33 wrote:4. In respect of a job offer in the UK (for an applicant's partner or parent's partner returning to salaried employment in the UK at paragraphs E-ECP.3.2.(a) and E- ECC.2.2.(a) of Appendix FM) a letter from the employer must be provided:
(a) confirming the job offer, the gross annual salary and the starting date of the employment which must be within 3 months of the applicant's partner's return to the UK; or
(b) enclosing a signed contract of employment, which must have a starting date within 3 months of the applicant's partner's return to the UK.
Remember, the applicant‟s partner can only rely on the income from a job offer in the UK under Category A if they have been in employment overseas at the required level of income for at least 6 months at the date of application.

Thanks Amber

This still leaves the matter open for debate though:

- does the job need to last the entire 2.5 initial years, at a minimum?
- does the job have to be at least 1 year in duration, so the Brit earns that annual salary in full?
- could the job be for one day, provided the Brit got paid $19k for that one days work? (Extreme example just to make the point)

Basically what I'm trying to get at here is do I need to acquire a full time, permanent, ongoing job, with no expiry date, before I can apply for the visa for my wife, or will a temporary 6 month or 1 year full time position satisfy the conditions?

For reference, job more than six months overseas condition covered

Thanks

A contract wouldn't be required, just a letter:
confirming the job offer, the gross annual salary and the starting date of the employment

My reading of the rules are that a contract position is allowed, and it doesn't have to be for the full 2.5 years. What it must show is an annual salary which exceeds your required income threshold (normally 18600, or less/more depending on savings/children etc). As far as I know, yes you can earn that in a contract for 1 day a year, or working part-time etc, there are no limitations, as long as it meets the income requirement.
Hope this helps!
