spouse visa (9 july 2012 rules)

Post by help_uk » Wed Dec 09, 2015 2:37 pm

hello guys,

would like to have some information regarding my visa, my situation:

applied for spouse visa within uk in july 2011, refused on aug 2011
applied for tribunal 1 in 2011 aug, visa granted for 4 to 6 month only.
applied for spouse visa on February 2012, refused December 2012
applied for tribunal 1 on december 2012, case withdrawn by home office and again refused.
applied for tribunal 1 on nov 2013, case won by us, but home office challenged in upper tribunal
applied to upper tribunal sep 2014, case won same day, received 2 years 6 month (resident permit)

Now my question is am i in category of 9 july 2012 rules or not?

I will be very very thankful if i get answer to my question :D

kind regards

It appears that as you have been issued with a visa for 2.5 years you are under the post-July 12 rules. Whether that has been correctly issued needs to be confirmed.

This link should help you.

You need to advise them that you believe you should have been issued a visa under the pre-July 12 Immigration Rules as your initial application was submitted in 2011.
