Hi,

I am here on WHV and my wife is on student visa. Currently none of us are dependent on each other in terms of visas. Her student visa is valid until the end of year. Is it possible that i can apply her dependent visa and get the work permit, please note that when the student visas was issued, it was valid for more than 12 months but now it is only valid for 8 months.

Your help in this regards will be higly appreciated

Such an application would be on a discretionary basis outside the rules..add in the fact that where one person in a spousal/ married couple applies for a WHV the other must also be eligible/ apply for a WHV (any reason why this is not the case?) and I expect the HO to want some more details......

Thanks for your reply. My wife doesnot have Working holiday visa is because when i applied it one and half year ago, i was single and i am married only few months ago. I hope this clarifies

That eliminates any concerns about the WHV eligibility as a couple - however consideration of the application to be a dependent remains concessionary outside the rules. Making the application is a decision only you can make. IMHO if finances are not an issue it is best to apply from your home country. Any visa granted is to the validity of your spouse's visa and is not a 'de facto' work permit. If it has no endorsment pertaining to employment prohibition/ restriction then you may work full time.

Hi,

Thanks for your reply and suggestion. I really appreciate it. The problem is that both of ours visa are expiring are with a difference of two months. She is still studying in uni and it will take more than a year to finish the degree. Is it a good idea when she applies for her student extension, she also include me as a dependent so this way we both get our visa renewed. Any comments will be higly appreciated

Sure you can be included as a dependent in the application to extend her student visa. This application must be made prior to the expiry of both your current visas.
