Spouse Visa

Hi,
I have a question on behalf of my friend:
She was married to a British Citizen. Her husband lived in the UK but she has lived in Iran. Now, her husband in Iran with her but because of an accident he is unemployed and receives unemployment benefit.

Then, can she apply for Spouse visa to go to the UK with her husband and settled there considering that her husband is not employed now.

If not, she has no problem in applying for Tier 4. Then, will not be any problem in applying for Tier 4 visa by a spouse of a British? I ask this question because intend to leave the UK is one of Tier 4 requirements but there will be no intention to leave the UK for a spouse of British citizen.

The funds required for Tier 4 may be higher than for spouses.

Thank you for your reply. As I saw, there is no specific money determined for spouse visa. But application process for spouse visa and persuading ECO is more difficult.

By the way, do you think someone with a British husband could apply for Tier 4 at all?

I've got more information from my friend. His husband gets 3500GBP tax free per month as disability benefit and lives in a governmental apartment which government rented to him free. He has no other saving or bank account, then do you think his wife could apply for spouse visa considering the above condition?

houman1979 why would someone apply for tier 4 when they have a british husband? It doesn't make any sense.

£3,500/ month rent free is a good amount of money. Sounds like your friends maintenance and acommodation requirement is taken care of.

I'm pretty sure benfits are taxable too - or is this money and insurance payout - already taxed?

Thanks for your replies. Maybe she didnt understand the matter and the benefit is taxable. But the point is that it seems she could apply for that visa.

But is it a benefit? sounds way too much to me.
