Spouse visa

Post by mitny » Fri Mar 11, 2011 4:35 pm

I am a British Citizen, married to an Indian National. We have been married for almost seven years, but have been living in the United States during this time. It is our intention to return to the UK to settle.

Am I correct in understanding that, since we have been married for more than four years, he is eligible to apply directly for ILR/ILE status without having to meet the two-year residency requirements? If not, what are his options for entering the UK as my spouse, and being able to work?

Thanks for your help in providing clarification on this.
