Spouse Visa

I am wondering if someone could please advise me on the following. My husband has a Family Visa which expires at the end of February 2012. His Spouse Visa application was applied for on the 12th October so 60 days is up on the 11th January 2012. If (god forbid) we get refused can I fly him over until his Family Visa expires and appeal or do the passport/docs need to stay at worldbridge in Cairo? Do they need his passport to appeal and does he need to be in Egypt to do this?

Assuming "Family visa" means "family visitor visa":
1. If the spouse visa application is refused, his visitor visa will remain valid until the date of his expiry.
2. He may travel to UK as a visitor during the validity of the visitor visa - irrespective of whether you appeal a refusal or not. That said, don't be surprised if he is questioned by an IO about entering UK as a visitor. If questioned, he may be required to convince the IO that he intends to return before the visitor visa expires.
3. The passport will be returned when a decision on the application is communicated to your husband. One does not need to submit a passport when submitting an appeal.
4. It is up to you whether you wish to submit the appeal at the issuing post (Cairo) or in UK.

one last question sushdmehta. As I sponsored him to come in August for the Family Vist visa will that been seen as favorable by the ECO for making a decision on the spouse visa especially where finances are concerned as I passed the financial test & accomodoation test for the family visa. Will they use the same rule for the spouse visa?

Oh butterfly its so emotional and a constant drain, i only wish there was a more updated tracking system in place with a progress bar so we could see at what stage the applications are up to..... it would give us light at the end of this very long journey......stay positive (easier said than done) because its out of our control :) Im sure the ECO are working very hard in order to complete their vast work load x x Good Luck xx

I know Kinsella - I have worked out I have 6 weeks yesterday until my 60 working days is up - seems like a lifetime away when you are without your loved one. thanks for all your support and the support of the people and the moderators on here. I am really glad I found this board and I dont feel so alone in this process which drains everyone emotionally. I fully agree Kinsella - arrived at the visa section doesnt tell you an awful lot. It would be better to see what process its up to or is it just sat on a shelf gathering dust. All we can do is wait I suppose xxx
