Spouse Visa, Tax Credits

Post by LeedsUK » Mon Oct 17, 2011 7:32 pm

Hi

Hope you can help me with a confusing problem.

My wife has just joined me on a two year spouse visa. I am british. I have been claiming Tax credits for a single person but I have now been told I need to make a joint claim as a couple.

The problem is my wife has no recourse to public funds and I believe tax credits is a public fund.

Am I allowed under immigration rules to make a joint claim and will this affect her application after the two years spouse visa period.

Thanks in advance

I have moved your topic to the Claiming Benefits section of this board, where this subject has been discussed at length. Start with the pinned topics to read the technical arguments.

And yes the Tax Credits claim does need to be put into joint names. Not to do that could amount to benefit fraud.
