Post by Jjulie » Tue May 05, 2020 2:26 pm

Hi.
My stamp 4eufam (british spouse) will expire on august I was wondering if its posible to extend for a year or so or If i could apply for a stamp 4 parent of irish child. I need more time as I want to apply for citizenship but I'm sort on time.
I email eu treaty rights they told me to apply for permanent residency.(I heard it's a nightmare)

Thank you

You should apply for EU3/permanent residence.

Who told you that it is a nightmare to apply for an EU3? The list of required documents is quite straightforward and it gives you permission to stay in Ireland permanently, regardless of your citizenship status.

While it is technically possible to apply for Stamp 4 based on Irish child, it might take longer as the GNIB/local immigration officer will not give you a stamp change without proper explanation.

They are likely going to refer you to the residence unit to apply for a new permission letter, which would take longer. They might even think you are involved in sham marriage which may further complicate your residence. That may also cause issues when you apply for citizenship, as it is certainly not a common scenario where a person switches from Stamp 4EUFAM to a different stamp.

Thank you for your reply.

I have left 3 months before my card expire, do you think they'll extend my time while I'm applying for this as I heard it may take more than 6 months.

I was/am quite confuse as in the web said you can renew your stamp 4 just apply 2 weeks before then it says after 5 years apply for permanent resident or naturalisation. That's why I thought I could apply that way.

You should apply for EU3 as soon as possible. It takes around 6 months (maybe a bit more under the current situation). GNIB or your local Garda station should be able to give you a temporary extension when your permission expires.

I don't think there would be anywhere on ISD website that would say that you can renew your stamp. The permission from EU1 specifically requires you to apply for EU3 six months before your 5-year permission expires. The 2-week renewal period applies to normal Stamp 4 holders, not Stamp 4EUFAM.
