Old company for start up or innovator visa

My brother just got ILR basis tier 1 entrepreneur category
His company is still active can I use the same
Company for innovator visa or start up visa?
Or any option can be done to add my husband in that company in order to bring him here under any visa type
Appreciate ur kind advise on this

It is not the age of the company but whether it is innovative, scalable, etc. that are the more critical criteria.

And of course the value that you (or your husband) will add to make it more innovative.
