status change - HSMP

Hi!
Iam on student visa (married) . Now my wife(now on dependent visa ) is eligible for HSMP.On apporval , do I need to go back to India to change my status or status from student to dependent can be done in HomeOffice (UK)

1. If your spouse applies for HSMP and gets an approval.

Since your spouse is in UK as a dependent, she will have to go back to India to apply for EC on the basis of HSMP. Once she returns to UK on her HSMP visa issued in India, you will then be able to apply for extension of stay in UK as her dependent (HSMP dependent). In my opinion, you will be able to switch from student to HSMP dependent in-country (from within UK) without the need to return to India.


2. If you apply for HSMP and get an approval.

You can switch from student visa to HSMP visa without the need to return to home country, provided you apply for LTR before your student visa expires. When you apply for LTR based on HSMP approval, you can include your wife as a dependent in the same application. This way she will be able to convert from student dependent to HSMP dependent without having to incur any additional application expenses.

I thought students have to complete their courses (degrees) before applying for HSMP... may be my understanding is wrong

Dear friends..

I had applied for FLR(0) form for converting my Student visa to HSMP dependent.I hold a masters degree from UK and presently on a Diploma course.I got my passport back along with spouse passport and supporting documents.The reason of refusing to convert my visa is stated as Under Act of 1971 sec 194, not describing in detail and stated that can't even appeal for this decision.. My question is Do I have to go back to my home country for EC ?? Few months ago my friend got his student visa converted to HSMP dependent here in UK.. I dont understand my visa is not cleared.. please help..
