statutory residency calculation problem after 15 months

hi guys
i applied for the naturalization around 16 months ago and i received the ref no. after two weeks. but now after the new website launched by doj my residency shows 27 days short. i read in the website that ur residency is calculated immediately upon the submission of apllication and if it is not complete file will be sent back within matter of weeks. so i don't understand what to do as i haven't got anything from inis in these 15 months and i am afraid they will send my file back after god knows how long? i don't know what to do? looks like wasted my two years. any suggesstions will be greatly appreciated.

It is very unlikely that your application will be returned at this stage. My understanding is that the calculation of the residency requirement is done earlier on in the processing, so if they had a problem with it you should have had it back long ago. My guess is that your application is currently under processing and you may get response in the incoming months. If you do have some time to spare Tuesday or Thursday next, give them a call in Tipperary to find out about the status of your application. or better still write them for update. You might be pleasantly surprised.

thank for your reply. i tried to call them from last 2 weeks and its near impossible to get through. i just hope and pray that u r right. i am feeling unbelieably low these days bcoz of this hassel

someone in the Department told me that they round stamps upwards to the nearest month, so - say your stamp goes from 25 Jan 2010 to 5 Jan 2011 - they will count this as 6 months or 365 days. Maybe the online residency counter counts every single day separately?

Thanx ! feeling lot better now. It will b gr8ly appreciated if any one knows any cases where the application has been sent back for this reason after so long time.

How they calculate it? using the passport or the GNIB card???

I think they get it from the GNIB computer system. You can write to the GNIB and ask them to send you a list of dates registered with them, for the purpose of naturalisation, this only takes a few days and they'll send it to you.

they calculate according to the stamps in the passport. from the date that the stamp was received, to the expiry date of the stamp. but making sure that the stamps do not overlap.

Yes - that's the point the GNIB system and the stamps should correspond exactly, but sometimes the stamps are not clear. Why don't you use the online calculator? I filled the new form for the first time yesterday and used the calculator, it's pretty cool. Mind you, the Dept staff will just have to go through and do the same thing, they won't take you word for it! But I suppose it prevents people applying too early and wasting the time of the Minister's staff.
