Student requires urgent advice regarding I.L.R.

Post by Nassy35 » Mon Feb 15, 2010 6:24 pm

My parents made an appeal by means of the 7year child concession in August 2007. This case is still pending. As a result of this, a complication has occurred regarding my degree course at University. I have lived in the UK since I was 13, and now I am 23. Throughout this time I’ve completed my education from 2000-2005(GCSE and A levels). I intended to study dietetics though I was offered a nutrition course instead (Dietetics is very competitive). After the first year I was offered to attend an interview with a chance of transferring to study Dietetics which is funded by the NHS. I was unsure of my eligibility so I explained my situation in detail to the NHS and also attached copies of Home Office letters which confirmed my status in this country. I received a letter which confirmed that I am eligible to study this course which made me very happy as it was the course I wanted to study initially. However 3 months into my second year the NHS reversed their decision to fund me on the grounds that I had started my degree without a settled status within the UK despite having fully explained my situation in the initial application made.
I have now been told I am no longer able to continue with the program. I have taken two years out before I started university, to work and save money to be able to fund my studies, not realising that I would be classed as an international student. My parents went through considerable hardship to help me finance my first year. As this situation has unfolded I am now left in an extremely difficult situation as my head of department at the University has granted me a limited amount of time to resolve this issue with the Home Office.
I have approached the student welfare and Citizen’s Advice Bureau, but there are no organisations or persons who can understand my situation to give me advice.

Any suggestions to what I could possibly do? Need my case to get sorted quickly, does it always take this long? can i be assessed individually? is there any compassion within the system which takes into account all my education recieved has been here, yet I'm classed as INTERNATIONAL!

Any feedback would be truely appreciated..

God Bless you

This is a difficult one. with regards to the 7year concession, was a decision made and then you appealed? i am not sure if the the fact that you were 20 in 2007 when the application was made would have any effect on the time delay or have any bearing on your chances for that matter. You may want to investigate the Human Rights Act Article 8, I dont know too much about it but i think it maybe a possible route to go. Other than that i really dont know.

Is the option of returning to your home country and applying for a student visa from there viable. I not sure if the chances of success are good especially considering that you will need to prove funding is available, but it is still an option.

To be honest i dont know if you will find a solution in a short space of time. Also you may want to get help from your MP in getting your case speeded up. i dont think it will affect the end result but you may get to know sooner.

International students are those from outside the EU and also include those who are 'Settled' in the UK, ie have Indefinite Leave to remain
