Student visa expiring/ PSW/ Continuous residence

Hello,

I have 2 questions and I hope anyone would be able to help me.

I have just graduated with a BSc degree and wants to apply for a post-study work visa but my student visa is expiring at the end of August therefore I was wondering if I was to stay in the UK and apply for it and by the time I get a response regarding my PSW (minimum of 1 month)..I will be in the UK without a visa...will this break the 10 years continuous long residence for permanent residence?

If I was to travel home a week before my visa expires and try to apply for it at my home country possibly before my student visa runs out or after my visa runs out. Will both of these cases break the 10 years continuous long residence?

Also, can I still apply for a PSW at my home country even if my student visa runs out??

If you make a valid application before your leave expires, then your leave will be extended after its expiry date under Section 3C & 3D.

1. No it wud not break the rule as u visa conditions will be extended automatically untill a decision has been reached.

2.Home Travel: If u leave the UK before u visa is expired and then re enter UK with an entry clearance then no u did not break the 10 years rule.

3. As long as U leave UK before the visa runs out u r fine but if u take more time (6 months at any one time) u will break the rule.


I do not understnd that if u have graduated and hav got u certificate then why not apply from UK instead of going bak home as u need to show more money. If u have got all the documents (Main thing maintenance for 3 months) then i wud strongly recommend to apply from here unless u got other reasons to go bak home.
