STUDENT VISA REFUSED CUS OF OVERSTAY reapplying after 1 year

I was reapplying for a new visa in DEC 2008 when it was refused because I had overstayed since the visa expired in OCT 2008. Any application was to be banned for one year.

So now it is coming up to one year and I would like to know, is it ok for me to start applying now? It is an online application and I want to complete it early because the dates for when you go to the Immigration Office take up to 3 months, so probably I can get a date in DEC 2009.
I'm not trying to apply while I'm banned.

Am I allowed to reapply this early? I'm worried that they will ban me for 10 years because of false misinterpretation??! Any help is greatly appreciated :)
