Study visa applicant with British Partner help

Post by catmando » Sat Jan 16, 2010 11:27 am

Hello everyone,
I am a UK citizen who has been dating a Canadian for 2 and a half years. She wants to come to the UK to study for an MA and then MSc. Although she chose her course entirely on its reputation (rather than to just be in the UK), we’re worried that immigration won’t see it that way, especially as she already has one MA (connected to the two new courses she wishes to take). I’m worried this could be seen as deception, just to get her into the UK for me, and that it may cause problems because students are expected to leave after their study ends, and so having a British boyfriend will make them suspicious she will stay. Obviously we don’t want to be dishonest on the visa form, so as it asks for unmarried partner details she is going to give my information. Still, this course is very important to her and I'd hate for me to be the reason she is declined entry.
There is also the problem that if we did decide to get married in the future and decide to stay in the UK (the entire two courses will be three years in total), again the immigration may see the time she spent as a student as deception and so cause us problems.
Am I being paranoid? Any and all help would be gratefully received.
Thanks,
Armando.

Hi, Armando

I am no expert, but I wonder why she has to mention that she has a British boyfriend. Besides, it is completely legal for a student to get married to a British citizen and stay here (to the best of my knowledge), so you shouldn't be concerned about what would happen in the future.

As a personal opinion, and given that your girlfriend is from a developed country, I don't think she'll have any problem getting a visa to come here. Also remember that in most cases an interview is not necessary for you to get a student visa, so it does not depend on the impression an officer would get, but on the facts in the documents she will produce.

A.

Hi,
Thanks for your reply. The reason we thought it best to mention me is that there is a box on the form that asks for marital status. One of the boxes says 'unmarried partner' and later on in section 5.2 it asks for 'spouse/partner's name' and other details. As there is the possibility that we might want to stay in the UK in the future, we didnt want to later fill in another application and have them ask why she said she was single at the time of studying, when she had clearly been in a long-term relationship beforehand (including visiting me for 6 months in the UK a couple of years ago). This type of info would all be in the proof of relationship we'd have to give.

I have noticed when looking through the forum that there are many people who state that they were in a relationship with a British citizen before getting a student visa, so I was wondering if they filled all that information in, and had no problems with immigration worrying they'd decide to just stay in the UK afterwards. I did notice that many of them went on to get spouse visas...so perhaps I should have posted my question under the marriage visa section too...
Thanks again,
Armando
