As you already hold permanent residence in Spain, how easy or difficult is it to get Spanish citizenship? As a Spanish citizen, you can be resident in the UK under EEA Regulations.

hello,
as you have mentioned that how easy & difficult to get spanish citizenship, but i would like to tell you we are at present living here on permanent residence card and to apply for spanish citizenship everyone has to complete 10 yrs of residency and still mine 3 years remaning, but my minor child was born in spain so he is holding spanish citizenship and we are having indian passport.
so we were planning to go to uk for short stay, someone told me that you dont have to apply toursit visa, but you can apply for EEA family permit because your is EEA national with spanish citizenship. so is it possible that we can apply EEA family permit. pls let know
many thnks for your reply

Non-EU parents of an EEA national can only apply for EEA Family Permit if they can show they are dependent on EEA child.
This is not the case here as both parents are non-EU parents of a minor EEA National.
Both of you can only travel to UK along with your child by applying for a short stay tourist visa.
"Direct family members must be wholly or mainly financially dependent on the EEA principal to meet his or her essential needs in order to qualify for an EEA family permit."

My suggestion to you is to write a nice covering letter highlighting that you live and work in Spain and your family is travelling to UK for tourist purpose. Don't put anything regarding the overstay in the letter but do add it in the application form.

In theory you could apply thru Chens Case from Spain. But your case would be much stronger if you are already in the UK.
Also find yourself a good lawyer to help you. Lots of scammer lawyers around.
