Surrinder singh route - Job in Ireland, Leave from UK job?

Post by sali11 » Tue Sep 01, 2015 10:29 am

Hi
I am planning to try surrinder singh route by moving to Ireland. I understand that I will have to be employed in Ireland as part of proof that I moved "center of life" to Ireland.
My question is that, do I have to resign from my UK job? If I take 6 months (unpaid) leave from my UK job (means I won't be getting P45), could that be a problem in proving my "centre of life" moved to Ireland?
Thanks

Yes, because you won't have moved 'the centre of your life' to Ireland. You will simply have taken extended leave (or a long working holiday). Surinder Singh applications are currently being refused if the case worker considers this route has been taken as pre-meditated means to 'circumvent the Immigration Rules'. In other words, if there was no real intention to move your life to Ireland and settle there.

The intention is to live there where the wife has her residence.

Thanks for the reply. So, even if I work in Ireland for 1 year, pay taxes over there, rent a house etc. and take 1 year leave from my UK employer, UKBA would know that I did not leave my job in UK?

Thanks
