Switch from Dependant to HSMP

Post by jbinuk » Thu Jan 11, 2007 4:32 pm

Hi,

A colleague of mine wanted to ask if it is possible to switch status from WP dependant to HSMP? She's currently here in UK and in full-time employment. What will happen to her LTR(IED) visa in case she obtains a HSMP approval? Does she need to also switch her LTR(IED) into LTR(HSMP) while here in UK? And what will be the impact on her future application of ILR when she already has completed 3 years?

Thanks for your opinions.

They can apply for HSMP from within the UK but they are in a 'non switchable category', so they cannot apply for FLR. If they are approved they need to leave the UK and apply for entry clearance.

Time spent as a dependant does not count towards ILR, so they would need to accumulate their own 5 years to qualify.
