Switch from Tier 2 ICT to Tier 1 - Earnings Evidence

Post by jijo » Sat Feb 12, 2011 9:01 am

Hi All,

Thanks for all for your contributions and this forum is really useful for people who is really in need of info & guidance.

Currently I am in UK in Tier 2 for past 1.5 years and I am planning to apply for Tier 1. But unfortunately I am in shortage of 5 points in earnings. After tried hard I found some contract work here in UK and currently working as part time consultant. I will get eligible salary by March and planning to apply by 2nd week of March.

Now I am in the process of preparing application and I have gone through the forum and got many required info. I have some queries regarding the earning evidence,

1. As I am working here as part time consultant , my salary is getting credited in my account. Now I have the invoices and Bank statements for this income. Do I need to give any other document to prove my earnings apart from Invoices and Bank statement?

2. When I come across this forum I found HMRC/UTR/NI 2 etc, whether I need to show all these? or its applicable only for self employment?

Can you people guide me on this as I have hardly one month to apply?

Thanks in advance.

You cannot be self-employed when on Tier 2! And invoices are one of the acceptable evidence(s) for self-employed applicants only.

Thanks Sushdmetha .... I have gone through the UKBA policy which allows ICT Visa holder can work for 20 hrs extra work per week, is there any other way to get the salary?

Kindly advice... I feel I am missing somewhere.. :?

Keep in mind that there is 10 year ban if they find false(made up) evidence

Salary is paid to employees. Invoices are submitted to clients, who in turn pay for work done.

The point is, invoices come in play when one works in a self-employed capacity. And, under Tier 2 you cannot be self-employed.

However, you may be employed with a different employer (other than one who sponsored your Tier 2) for employment restricted to 20 hours per week. The employment terms and conditions should highlight this restriction and your payslips should also reflect the same (hourly rate of pay, for a max. 20 hours per week / equivalent in a month).
