Switch from Tier4 to Spouse (TLR)

Hello,
I am going to submit my application next week for a spouse visa.
I have some questions:

1- it seems like there is one application for the 5 year route and the 10 year route. If i was denied the 5 year route can i apply for the 10 year route? how can i do that?

2- my partner has been working with the same company for the past 6 months but he does not meet the minimum required income. I started a fixed term job last month so by combining our income we do meet the requirement? would that be enough evidence?

3- we also have some money in the saving account, financial gifts since we got married last month? would they be taken into consideration since we do not have them for the past 6 months?

1 - if your application is refused under the 5 year route they tend to automatically consider the 10 year route, which is leave outside the rules and is generally decided on human rights' grounds.

2 - once you've been working for 6 months your incomes can be combined. Yours will not be considered until the 6 month mark and so it looks like your application is likely to be refused.

3 - again savings will only be considered (above the appropriate amount which is 16,000 + (2.5 x shortfall in income)) once held for 6 months or more.

Can you not wait to apply until you have been in your job for 6 months as it looks like a refusal is likely? The people who tend to be accepted on the 10 year route have British children... do you?

thank you so much for your reply.

visa expires on the 15th of January ... i was hoping to to be considered on the 10 year route since because we are a same sex couple and my partner who is a british citizen cannot move and work there. Gay men are prosecuted and he wont be able to live nor work in Lebanon.

I dont know... Am i supposed to go back to my home country and re apply because we do not match the minimum recquire income and that i have not been working for 6 months?
it doesnt understant how am i going to be married and living in a different country... until when?
