Switch: Student Dependant to Tier 1

Hi

I am currently in the UK as a dependent on my wife's Student Visa. I now qualify for Tier 1 (HSMP) and intend to apply in May/ June 08. Should my wife apply as my dependent on Tier 1 or should she retain her Student status?

Could someone throw light on any additional procedure, I would need to follow in my case? I think Entry Clearance would be a must, but am not aware of any other special requirements I need to fulfill. Help and Guidance on this will be much appreciated.

What is the current processing time for Tier 1 applications?

I think you you only should apply first, and if and when the Tier 1 is granted, then your wife should switch to be your dependent on Tier 1.

Any specific reason why I should not apply for my wife as my dependent in the same application? I think this way it would be on once that I have to pay the high ~ £ 750 as fees!

Would there be any other necessary procedure apart from Entry Clearance requirement, for which I am prepared to go back to my home country.

As a dependant you have the same status as your wife, so you can switch to Tier 1. You wouldn't need to go back home for FLR either and can do everything from UK. There is also nothing stopping you having your wife as your dependant and she'll get the same Tier 1 status and be able to work where she wishes.

Hi

I don't know if it is my misunderstanding, but as far as I understood, to change from Student or Student Dependant status to Tier 1 I would need an EC. Could you provide me a quote/reference from the Tier 1 Policy guidelines, that confirms what you are saying?

I am so confused now :? Clarification will help

I also think the same that you have to go to your home country to change your status but now for tier 1 application we are sending our passport along with the application and fees is also higher which also confuse me that entry stamp( visa) will be given from with in uk or from the home country. :?:

Hi

Any updates, whether a Student Dependant can apply for Tier 1 from UK? Or does he have to return to his home country?

Hi,

Does this mean that we have to quit our jobs and go to India just to apply, and it takes 5 to 14weeks for the application to be processed. Can anybody advice.

Thank you. So i guess i must take the risk of loosing my job and go to india to apply for my tier1. Any idea how long the process take. i heared that it can take anything between 5 to 14 weeks. I will have to give up my house, cancell my landline and internet, because i wont know howlong this is going to take. it is absolutely ridiculous that they just cant provide the service from here and u get the EC from your home town.

Hi ALL,

I have called BIA and have been clearly advised that we cannot apply for TIER 1.

Please note:

You MUST apply from your country of origin.

Tier1 follows the same process in India as here in the UK.

You must send your passport allong with the application so entry clearance will be done at the same time.

You must show fund for maintenance over 3months GBP2800 and GBP1600 for every dependant.

The visa process usually take 15-20 WORKING days. But if your application has to go through the INTEGRA SCREEN , it can take longer.
