Switching in UK to Another company

Hi,

I am in UK on the short term ICT Visa expiring towards end of August 2012. The IT support service I was working for with the current employer has been taken over by another company. Most of the UK staff is being TUPE to the new company which won the service. However I am not sure if I get TUPE to this new company (A rated Sponserer), will they be able to apply a new VISA for me under Tier2 category (ICT or general) so that I can continue working for them in UK?

I need to get an clarity on my visa situation. Please try to reply this query asap.

When did you first apply for Tier 2 (ICT) short-term staff visa?
What was the duration of that visa?

Visa start date is August 2011 and duration is 12 months (It comes under the category of short term).

In such case:
The Tier 2 (ICT) short term staff leave cannot be extended (245GE(a)).
You cannot switch from Tier 2 (ICT) short-term staff to Tier 2 (General) (245HD(c)).

Just to be clear, even if I continue with the same employer, will they not be able to apply Tier 2 (ICT - Long term Staff) type visa for me so that I can continue to be in UK after August 2012?
