Hey everyone. Really hoping someone can shed some light on my situation as I'm sure someone out there has been in something similar.

So I'm moving to a new company, to start Sept 1st so I can put in 6 months before my psw visa expires and get my Cert. of Sponsorship. But I'm worried about the application. My visa expires on March 2nd and my 6 months passes on March 1st.

So reading the rules, I need to be 6 months in at the time of my application right? So that means I need to wait until the 1st of March to submit my app so that the information is accurate? What happens if my application is processing and my visa is expired? I'm thinking I need to pay the premium and do it in person but there is no guarantee I'll get in on the 1st or 2nd.

I just need some advice on what I can do. I feel like I have 48 hour window of time here.

Are you sure about your information? I thought the employer could not issue a COS without a labour Market test unless you have worked for them for 6 months - the date of application comes after.

Yes you are right. So I will get the CoS after my 6 months, which is the day before my visa expires. So that's what I'm worried about, is can I submit an application and stay on an expired visa while it's processing or do I need to get my CoS and then go straight to a visa office to apply in person.

Since you've still got time, can you not ask your employer if you can start earlier? Even if its unpaid or something so that you can fulfil the 6 months criteria.

As far as I'm aware, they dont require 6 months pay-checks, maybe a letter would do by your employer stating you've been working for them for more than 6 months?

Wrong/

The way you prove you have been working for the Employer is by either,

1. Providing 6 months payslips

or
2. Providing Bank statements of last 6 months payments from your employer

or
3. Bank society

Its 6 months if you're switching from PSW & 12 Months for ICT
