Switching from PSW Visa to Tier 2 AFTER Visa expires

Is it possible to switch from Post Study Work Visa to Tier 2 Visa AFTER my Post Study Work Visa expires and I return to my country?

Switching is a term used when applications are made from within the UK.

You may apply for EC as Tier 2 migrant from home country as and when you wish (before or after expiry of your Tier 1 (PSW) visa).

Entry clearance (leave to enter or visa when application is made outside the UK).

Does my employer have to clear Resident Labor Market Test if he wants to sponsor me AFTER my current visa (Post Study Work) expires and I return to India and apply for the Tier 2 Visa?
