hi everyone

i am quite confused where to go and ask for information so if anyone can give me some information on my case, will be deeply appreciated.

My case:

I came to UK on a student visa to do masters, which i completed and granted a SEGS work permit to work here. My work permit expired on 31st march 08 and my company applied for a WP1 application on 6th march08. Now as my segs was FLR and Work permit together, i was asked to send an FLR IED form to home office with my passport before 31st march 08 which i did. The Initial application of WP1 was refused, my company has made an appeal and waiting for the reply but if in case it doesnt work they are willing to put another application as there were slight issue with salary of few hundered pounds which was made clear in appeal.

now as my flr has ran out and my wp application is in process with my FLR IED and passport with home office. i am wondering if this could affect me in any ways?

second question is if i wana apply for tier 1 (hsmp) within UK, can i apply for it without having valid leave to remain. will i be eligible to do that as i submitted my flr well within time before it ran out with a thought that my WP will be ok.

if any one can give me some information regarding, i will be very thankful as home office website doesnt say much about different cases.

What is my immigration status while my application is being decided?
If you make an application before your authorised stay ends, your existing immigration status will continue until your application is decided, even if the decision is not made until after the end of your permitted stay. If your existing visa or other permission to stay here allows you to work, you can continue to do so until your case is decided. http://www.ukba.homeoffice.gov.uk/worki ... orkpermit/

Don't think so you can. Since IGS is not extendable beyond 1 yr, I believe your current immigration status is deemed extended (legal) thanks to the under-process WP application. Tier 1 application from within UK requires that you have an existing valid leave to remain.

I am sure loopholes do exist, but not sure if you will have the time to explore them on your own and accordingly prepare your Tier 1 application. Maybe you would want to seek independent advice from a legal mind.
