Switching from Tier 2 to Tier 1

Hi

I have got a contract and my consultant has agreed for tier 2 incase I do not get tier 1 due to the limit, i would be applying for tier 1 in dec.

I wanted to know can I apply for tier 1 as soon as i reach uk on tier 2
