Switching from tier 2 to tier 1

Hi -

Let me congratulate you team for doing such wonderful work. i tried to read through relevant topic which are already there and they helped me a bit. but i have following query

If applicants applying to switch to Tier 1 from Tier 2 (ICT) and current Tier 2 -COS letter is about expire in 1 month period of time then -

1. Is applicant allowed to work with current employer if decision is not reach before current COS expire

2. Can current employer initiate the process for issuance of new CoS & if they do so, what will happen to applicant's tier 1 application which is submitted earlier
