Switching - Marriage Visa to Work Permit

Post by sampson » Wed Sep 07, 2005 7:17 pm

Is it possible for a non-EU person who is married to a UK citizen, whose marriage has failed within the 2-year marriage visa period, to switch to a work permit, remain in the UK and re-marry a UK citizen following divorce?

Assumptions: Decree Absolute comes through before the end of the existing 2-year marriage visa period (possibly 3 months before the end)

Switch only on the most compelling of grounds to include serious illness or destitution of dependent children were they to be left here (to include why they are being left) if required to apply for WP visa overseas. If this is not the case then go back to a country of which you are a national or legal long term resident (not a visitor) and apply for WP visa or spouse visa on basis of new marriage.

Alternatively depending on the timelines apply for Certificate of Approval for in country marriage with subsequent switch to spouse visa. I would expect some form of leave on Form FLR (O) being applied for prior to the COA on the basis of the failed marriage with intention to re-marry. The costs (FLR O, COA then FLR M) and stress of this would put me off though.
