Switching To Tier 2 after ILR refusal on T1

I have submitted application to switch to skilled worker application after ILR refused on T1 Entrepreneur , application was done within 14 days window using super priority service

Today i received email that "A decision on your application has been delayed as a result of requesting further information from your sponsor"

I have been in contact with my sponsor and here is what he received
"We are in receipt of a Visa Application for the above named applicant. We note the salary is not appropriate for SOC code 3554 .
The current salary is under the minimum pro-rated requirement, please amend the salary and or working hours on the sponsor notes of the assigned Certificate of Sponsorship (COS) to meet the guidelines within 10 working days."

reviewing COS

1. salary offered for the Marketing Executive position (£39000 for 37.5 hours)
2. minimum 'standard' salary of £38,700 per year
3. 'going rate' for the specific job type, which is £30960.

So i think there is a mistake from HO side , however i would like to make sure that i didn't miss any point here and my understanding is correct
