Switching Tier 2 to tier 4 depndent

Hi
I need help from Immigration expert,
I am workpermit holder in uk since october 2005 as a Sr .Car assistant.
but on 2006, my comoany change management and i lost my job.
I allready spend so much money for wp so i no go back to homecountry
and work in uk as assistant.
In 2008. my wife come on my depndent ( i show enough bank balance ) and she work as well.

Now, trouble start

next october 2010 i finish my 5 years
so what i need to do ?

can I go for ILR ?( I HAVE NO ANY COMPANY DOCUMENT WITH ME )

OR
CAN MY WIFE GO BACK TO home countery and change her status Workpermit depndent to student ? and than I apply for student dependent ?


or

I apply for HSMP ?I know we did wrong but we have no opestion left.

Anyone please give me right suggeation and infromation
