switching to tier 2 visa

My situation is as follows
* i have a tier 2 dependent visa and permenent employee in a company with salary £28,000

If my company want to sponser me to switch to tier 2 main applicant do they need to do labour market test as im already working for them

As im in dependent visa cant they sponser me without doing labour market test?
