Tax and National insurance in naturalization

Post by MIbrahim » Tue Feb 23, 2021 10:47 am

Hi

I have a question on regards good character when it comes to tax check and national insurance contribution

In the 5 years qualifing period i have about 2 years of no work and three other years of work outside the uk with non uk based company

In the National insurance record it shows gap in all these years , as i believed im not obligated to pay national insurance as i never worked in UK but at the same time i had to pay tax in both countries which was done, but for one of the years i filed late and paid penalty for late payment but for some reason i have not gotten late filing penalty yet

Do you think this will impact my good character in the application, do i need to pay the voluntary NI , and do i have mention the late filing of one of the tax years :?

Thanks
M

There are no specific financial requirements for naturalisation, such as income levels. The only requirement is that any tax and NI due have been paid and any arrangements with HMRC have been complied with. You can be unemployed, retired, never paid tax, etc. Voluntary NI is just that, voluntary, there's no obligation to pay (it could though boost your state pension eventually ....). You have complied with the requirements and no need to mention tax penalties, many people get those.

Many thanks for your reply

One of the concerns i have is the late filing penalty that still has not flagged in my account , where i was planning to appeal if anything comes through , and to be honest im just waiting for the hit :)

Im not sure whether i need to mention it in the application or not

Thanks

Unless HMRC take you to court there's nothing to declare. Late Filing Penalties are not criminal matters, rather between you and HMRC. As long as you comply with your obligations it's fine.
