Temporary Admission for Transit Patient Fell ill on Flight

Hi Guys

My mum was transiting on to the states via London and fell ill on the flight. She was going to the US for medical treatment but could not continue the flight.

The airline rushed her to the nearest hospital as she was suffering acute pains and a few days later suffered a stroke and was then transferred to another hospital. At this point they decided to conduct an amputation of the leg and so as you can gather this all came as a great shock to us all.

The hospital has been great, and the team of Dr's did the best they could do. Unfortunately the Oversees Officer received a letter saying that my mum was only granted Temp Admission until XX August and is liable for detention upon discharge.

The Dr's have said they plan to discharge her from the hospital to our home in the next few days for home care, but we concerned that this might cause problems with Immigration. She is not medically fit to fly and as you can gather is still not fully healed

Our concern is that at her age and what she has gone through any detention will most likely cause her blood pressure to go up and the risk of another stroke are high.

I am an EEU citizen who has worked in the UK for several year but currently working abroad, my brother is resident here (Permanent Resident) but a stay at home dad.

I really dont want my mum to be detained or moved for the next few months at the very least, as she has lost the use of her leg and also her one hand due to the stroke and so I really want to make sure she receives the correct rehab etc.

Please note we are paying for all her medical expenses and are not recoursing to public funds.

You don't mention any nationalities, but presumably your mother requires but does not have a visa for the UK, hence her admission on a "Temporary" basis, presumably on form IS96. This does indeed say that she is liable to be detained, but in practice it is inconceivable that someone in her condition would be detained. When she is due for discharge from hospital, a new IS96 should be issued designating your home as her address. After a severe illness like a stroke and leg amputation, there is bound to be a lengthy recuperation period, and she will not be expected to leave the country until doctors declare her fit to travel. Immigration will require doctors notes if an extension of Temporary Admission is required.

Sorry for not being straight to the point just a lot has gone on in my head at the moment and is probably as jumbled as my message. :lol:

The main question was what options do I have to extend her stay but I think Mr Rusty has answered that quite well.

So should I go in person to the office or is there an application form for the extension of the IS96. Thanks

Just phone up the office that's dealing with her and ask to speak to "Casework". You'll need the Port Reference Number on the IS96.
