The recent HSMP JR clearly stated that the applicaton for the extension or settlement should be processed in accordance to the rule which were in place during their initial application and Home Office agreed to that.

So if they change the rule again for the path to citizenship (or) PR, is that not going to result in another similar case that of HSMP JR? because I feel almost all of the HSMP/Tier 1/Tier 2 migrants will be affected because of the change.

I'm aware that the bill will be passed in 2011 but what is surprising is that the draft for the new citizenship path haven't considered the migrants who have already entered the uk :(

So my question is whether the new path to citizenship will resulst in another smilar case that of HSMP JR if they don't consider economic migrants already entered the UK under different set of rules????

It's based on a statute so no, there won't be any judicial review unless the courts choose to act in defiance of Parliament.
