i have limited leave to remain as a student.am qualifiy for PSW but the local authority said i must apply for discretional leave to remain..this is my story.my partner is british she got 2 kids in full care with her ex partner who she sees once in 6 weeks in a supervised conatact center.now she got a baby for me 5 month ago,the local authority took the baby from her and called me from school that my son will go for adoption because of the mother history and because he is young and he is an hot cake for adoption they said that she cant take care of the kid and that she can harm the kid,we went to court and i gave myself up for my son and i was assesed in a father and baby unit for more than 2 month and the result comes positive.the local authority said i need to stay in uk and take care of my son.have been taking care of my son since he was 2months.they got me a flat and made an agreement to be paying pending i have my DLR they also give me money to take care of the child since i cant have child benefits.the local authority accessed all my partner family members and all came out negative,they assesed my family in africa its also came negative.I am the only carer of my son and the court is about to give me a resident order on him and his mum a contact order.Presently my the kid mum sees the child twice a week and his grandmum (british) sees him once in a month and his other half siblings(british) sees him onces in 6 weeks.The local authority said i cant take the child back home because of his mum there is risk that she might come to take him forcefully because my country is corupt and because her contact is supervised and they want to always supervised the contact for the sake of the child because of her history and there is nothing like social services in my country.she cant have contact with the child through me because they want it supervised because of her history and she assulted me and the social worker but i didnt charge her but they are charging her.I am so worried please advised

any advise will be apprecaited...the local authority said they are ready to give me any supporting document.and right now they have an ICO on the child,interim care order which mean we are both sharing the parental responsibility.We are due to go court in 1 month time which might be the final hearing where i will be giving an resident order and the mother a contact order which is guranteed and i was told i needed to apply for the DLR as soon as possible.My family lawyer linked me with an immigration lawyer who says i have a case and he billed me around 800 pounds the local authority are ready to pay for it...but am scared am qualfied for PSW because with all these i struggled to finished my masters.i love my son so much and he have become a part of my life...please help

thanks for your advise,the immigration lawyer told me acess to a child is leave to enter not leave to remain,he said i qualify for it but am sure the mother and the local authority will not let me go with my son,where will i put him?

Talk to the social worker and ask them for some legal support if they are saying you are able to care for the child they should be pulling out everything to help you do what is best for the child and if their advise is to return and apply they will make suitable arrangements for the child in the interim

Do not panic follow what they say - what is your current status in the UK

thanks,the issue was the family court directed my family lawyer to go and get an advise from an immigration expert on how i can change my status,the immigration lawyer advised that i have 3 options,1,apply for my post study work 2,discreational leave 3.acess to a child....the local authority said the best i can apply for is discreational leave to remain so i can take care of my child on own own....they are all focusing on DL...my lawyer is also saying DL....just want advise
