This very complicated situation but I need help advice or hope

Post by Bonney » Wed Mar 22, 2023 2:06 pm

I am a British Citizen I’m born in the Uk I have 3 children 12, 4 and 2. My partner is not a British Citizen we are not married he is a Portuguese National he had the right to stay in the UK when he first came to the country at 10 years old with his family, but when he turned 16 he got involved with the wrong crowd and went to prison, he done 2 years and became an adult when it’s was time to come out of prison he went straight to a deporting centre at the time I was pregnant with our first child.

We were so young we didn’t know our rights he never came with me to sign his name on birth certificate because he was in prison at the time (no proof he has a child) and after couple years in the deporting centre they deported him couple years later he illegally came back into the uk and was caught and deported again this happened 3 times , he is in the Uk now entered illegally we now have 3 kids and have got a solicitor trying to sort this problem out to see if deportation order can be revoked so he can then apply for the settlement scheme. Soon as we got a solicitor and they notified them that he was here we got a bail 201 form in December 2021 he has to sign on every 2 weeks not aloud to work or study very sad situation, like I said I’m British my kids have British passports, 3 of them born here. I have contacted MP, Mp basically just told us that they said we have to wait. We have also contacted where he signs on to try get his conditions varied so he can work while he waits still waiting for them to respond, it’s been 2 weeks. I don’t think they know he has 3 children because we are waiting for his case to be looked at we have the proof we have children which we sorted and gave to solicitor

How long will he have to keep signing on ?
Solicitor says we just have to wait?
What is the longest someone has had to sign on for ???
I feel he should have the right to stay in the Uk he committed a crime when he was 16 years of age we are now both 29 years old we make mistakes he’s never done anything bad since we have 3 children Myself and children have never lived any where else appart from Uk we need him here in the Uk we need him !!

Talking to an immigration lawyer is your best bet. So you're already on the right channel.

You said he hasn't done anything bad since he was 16, yet he has illegally entered the UK 3 times since he was deported. That is serial offending. No disregards for the laws of the land. Not sure how you want the government to feel with that. There's not one rule for others, and one rule for you. It's one size fits all.

That is breaking the law. There are no small crimes and big crimes (hypothetically speaking). In the eyes of the HO, he doesn't have to live here in the UK. You guys can always move to Portugal or any of the many EU countries and live with him. Just saying it the way I see it.

However, like I earlier said, you're already on the pathway forward.
No sin in failing, you just have to try and try again!

Yes I understand and your are right, only to be with his family and because we felt he should have never been deported in the first place he has no family in Portugal I myself have never lived anywhere but the uk my kids go to school in the UK I can’t just uproot my whole life to go live out of the Uk, how long will he have to wait for this decision? it’s been 13 months he has been signing on I’m so depressed we are living of my small income with 3 kids very hard situation.
