Tier 1 Dependent extension

Post by suresh505 » Fri Sep 19, 2014 11:28 am

Here's another confusion regarding the ever changing rules and requirements:-

This document contains the following:
The applicant must be the spouse, civil partner, unmarried
partner or same sex partner of a person who:
o has leave as a PBS migrant

o is being granted leave at the same time as a PBS
migrant, or

o if the applicant is applying for an extension of stay, their
partner must have indefinite leave to remain (ILR) as a
PBS migrant or have obtained British citizenship after
having ILR as PBS migrant.
I'm worried about the 3rd point. Do I need to have an ILR while applying for an extension for my wife who is a Tier 1 dependent?

your question's answer is in the statement

''The applicant must be the spouse, civil partner, unmarried
partner or same sex partner of a person who:
has leave as a PBS migrant''

The point you are worried about is different which means if main applicant get ILR through PBS route and her/his spouse does not qualify for ILR then he/she can extend leave as PBS dependent.

But if main applicant get his ILR through long residency basis which is not through PBS route then spouse is unable to get further extension as PBS dependent.

senior members correct me if I am wrong.
