Tier 1 Dependent to ILR

Post by sahib1992 » Thu Apr 29, 2021 3:16 pm

Hi All,

I'm planning to apply for my under 18 son's ILR. He is on my Tier 1 Entrepreneur Dependent. His 5 years has been completed now and I got my British Passport too last month.

I want to know which form I should be using SET (O) or SET (F) to apply his ILR?

Thanks :)

Children do NOT have a 5-year requirement for ILR. :!:
A non-UK born child can simply settle anytime both parents are settled. What is the immigration status of your spouse?

Thank you so much Zimba for your quick response.

My wife is on the Tier 1 Entrepreneur Dependent visa. She needs some time to pass her english test then I will apply for her ILR next year.

Inshort:

So one parent (Father) has British Passport and one parent(Mother) has Tier 1 Entrepreneur Dependent visa.

Then your child will follow the same immigration path as your spouse. They both then apply for ILR together. The fact that you are a citizen is irrelevant.
