tier 1 dependent visa appeal date

i am on tier 1 g migrant visa and eligible for ILR from 14 april 2014.
My wife applied for dependent visa in april 2013 but unfortunately refused.

she was student in uk during 2009 before but could not complete study as family called back home for marriage . second time issued visa as student on 2011 but licence revoked .

dependent visa refused under 319 c(d) subsisting marriage ,319c(e)may not stay with sponsor through out stay ,319c(f) may stay beyond leave granted .
now appel under process n date is 10 mar 2014 my ILR eligible from 14 april 2014 .
my legal adviser is confident and said under article 8 appeal may get allowed.
we have all documents about relationship from 2009 till 2014. But her study visa under scrutiny . i am confused what to do ?

do u think i should postpone date till my ILR or go head with appeal before ILR ?
