Tier 1 dependent Visa for child born in UK

Hi,

I am on Tier 1 (General) visa and I have my wife and a son in addition to my daughter who is born recently.

My wife and son are already on dependent visa. Due to unforeseen circumstances, we need to go to India urgently in March. Because of that, I need to apply for depemdent visa for my daughter.

My question is that how much amount should be there in my bank account(s) as maintenance fund? As I understand, I should be having a balance of 800 +3*533 = £2399 in my account for the last 3 months.
As this was an unforeseen circumstance, I wasn't able to maintain that much balance in my UK account. Over the last 3 months, the balance in my UK accounts has been maintained just over £1300.

Can I show money in my NRE account as maintenance fund?
Also, I have sufficient money in my resident Indian account. Can I show that as my maintenance fund as well?

I am quite desperate and I am not sure what to do? I would appreciate any piece of advise that I could get.

You will be making one PBS dependant application (you and your other family members already have their leave). You need to show maintenance of 533 pounds held over a period of three months. However, if you have been in the UK for less than 12 months (you did not specify how long you have been there) the maintenance requirement is 1600 pounds.

Sorry, I forgot to mention that. I am in UK for 3.5 years.

As per the PBS Dependent visa policy :-

"43. If the Tier 1 Migrant has been in the United Kingdom for 12 months or more, each family 43. member of the Tier 1 Migrant must have £533 to support himself/herself."

"45. If the same Tier 1 Migrant and his family had been present in the UK for two years, they would 45. require evidence that they held £2399 (£533 x 3 = £1599 + £800) in available funds."

"46. If a family member applies separately from the Tier 1 Migrant, there must still be enough funds to support each member of the family. Therefore in the example above, if the family has a third child, the main applicant has been in the United Kingdom for two years and the family applies for leave to remain for the third child separately, they must provide evidence that they have an additional £533 in available funds."

So, it looks like I will have to show £ 2399 as the balance. Is my understanding correct?

Now, the question is whether I can show the balance in my NRE account as part of the maintenance fund. The money in that account is repatriable and I can access it from UK.

No, it's completely incorrect. Here is an elaboration of the PBS maintenance requirements citing the relevant immigration rules and the PBS dependant guidance.

Yes you can show your foregin account as maintenance fund. There are few bits you must know before you do it.

1. The bank should be regulated by SBI.
2. The bank statement is on official bank stationary and must not be older than 28 days before date of application.
3. lastly, the exchange rate applicable will be the one flashing on http://www.oanda.com on the date of application.

So make sure you have that much fund on your name that can cover the convertion rate difference.

How About Going to India and getting Visitor Visa from there. I suppose that will be quite cheap as compared to getting Visa from UK, but my query is since the child is born in UK, will that be easy to get the visitor Visa from India ?
Immigration people might raise their eyebrows on getting the visitor visa only for child in INDIA.
