Tier 1: Doubt for filling forms-Question D5 bit confused

Dear Folks,

I am on work permit for about 2 years and I would like to switch over to Tier 1 soon. I am about to apply for Tier 1 in few days. I couldn't understand Question D5 in the below link on page 20.

Question D5:
D5. Are either the applicant’s current and/or any one of his/her previous passport(s) or travel document(s) that he/she has used to travel to, and remain in, the United Kingdom which shows his/her current leave unavailable?

Yes - go to question D6 No - go to question D11

I donot know whether to say Yes or NO for D5. I was wondering whether it is related to applicants who hold 2 passports or applicants without visa or expired one

my work permit is valid till 2013(5 years one)
I have my work permit stamped on the old /expired passport. I got the new passport few months back . I don't know whether question
D5 is related to that or for illegal immigrants/visa expired people.

Do you have the vignette on your new passport?Or you are using both the passports to travel abroad? also, what does Q6 and Q11 say ? accordingly you can decide your ans for QD5.
I guess, if the new passport do not have Visa stamp in it then your asnwer for D5 should be "yes".if the new passport has the visa stamp on it then ans to be "No". Lets wait for other's comments!!

if i say yes i have to fill D6,7,8,9,10
if i say No i have fill up only D11 which is D11. What is the applicant’s current immigration status in the United Kingdom? my ans is WORK PERMIT VISA.

Questions D6 to D10 are as shown below.
D6. At which port did the applicant enter the United Kingdom?
D7. How did the applicant enter the United Kingdom?
D8. Give details of the journey, including where the applicant travelled from, ticket booking or reference number, and transport operator.

D9. For what purpose did the applicant enter the United Kingdom?
D10. When did the applicant arrive in the United Kingdom?

You should say NO and fill the D.11 as WORK PERMIT VISA
