Tier 1 Entrepreneur Extension Chances

Hello, I am a tier 1 entrepreneur visa holder (switch from psw to 50k route) and this is my beginning of 3rd year. I was doing everything which has to be done to get the extension and actually did try to establish genuine business. I am a software developer by profession and I did work with nearly 4 clients in the past, one of them was long term and at the same time I run a shop for 6 months which wasn't successful. I am also doing some accessory design business which is ok but again not highly successful and still working on it. I employed 2 employees and so far I believed everything was ok untill I recently see the new rules introduced including the removal of appeal rights which worries me a lot currently more than improving my business

The reason being is I spend nearly 40K already , worked nearly 12 to 14 hours every day for past 2 years (excluding some weekends). Because my business wasn't very successful I couldn't earn much money the last thing I can wish for is my application for extension got rejected for some silly reason and I cannot appeal. The reason I worry about this is because I had a bad experience when I apply for the entrepreneur initial visa, I got rejected by one caseworker saying some kind of details missing from the bank letter but in fact it was the template I downloaded from the ukba policy guidance itself. When I applied second time all I done was put a covering letter confirming I downloaded this from policy guidance and I got the visa approved

Would someone please tell me what are my options now, do I need to wait for 1 more year doing everything right and test my luck or what else. The money I invested was all I had as savings

Deepak my friend, dont worry to much about it. Everyone here is in the same boat including me. It doesnt matter if the business is successful or not. All UKBA needs is you investing your 50k in your business/businesses and employ 2 workers. Looks like you are on the right track.

I understand theres no right of appeal. However you can still go for Admin Review and maybe Judicial Review (not 100% sure about this) after that. And if this doesnt work then you can even make a fresh application within 28 days

All I can say is think positive and go for it :)

So its for sure now that if in case our Tier 1 Ent extension application got rejected then we can not go in appeal :shock:

are you 100% sure ?

Entrepreneur9 is right. There ain't any appeal right now. I hope they will not make us a victim like toeic.

Hi, thanks for your replies and yes I do hope everything will go right but I do have one more question. The more we read these rules the more complex and tough to understand. I read that contract for service is ok but contract of service is not acceptable

Along with running my design business I also do software/web development service and I have had around 6 clients (all of them are medium size limited companies) in the past 2 years. One of them was long term and others are short term like 1 month or 3 month etc, is these kind of service ok under new rule of contract for service (I run this service on a self employed basis because it was straight forward take the client requirement then deliver the software or website and invoice them)
