Tier 1 Entrepreneur Form

Hello,

Am currently completing my tier 1 entrepreneur form. Am a bit confused about the section D. Which is the immigration history section.

My situation is that I had a PSW visa which expired on the 13/Dec/2012. I applied for my first Entrepreneur application on the 12/Dec/2012. That application was unsuccessful. I just had confirmation from the Upper Tribunal that my appeal has been unsuccessful. So I have 28 days from the date the letter is written to submit a fresh application.

On section D of the form, the following questions are a bit confusing, considering my situation:

D4) When does your current leave expire? Should I put 13/Dec/2012 or the date on the Upper Tribunal letter which is 20/03/2014

D8) Have you ever stayed in the UK beyond the end of your period to leave? Should I answer Yes or No?

D13) Do you currently have an appeal with the Asylum and Immigration Chamber which is yet to be heard? I have ticked the "No" box. If am wrong please let me know.

I will really appreciate your answers and advise to these slightly confusing questions.

Ans: It should be the date you receive the UT decision. This is the date that your section 3C extension of previous leave stops.
D8) Have you ever stayed in the UK beyond the end of your period to leave? Should I answer Yes or No?
Ans: Your answer should be NO as you have not deliberately overstayed. Even if HO count the days between UT decision and new application as overstaying period, they will have to disregard it when deciding your new application due to the grace period of 28days overstaying period allowed under the rule.
D13) Do you currently have an appeal with the Asylum and Immigration Chamber which is yet to be heard? I have ticked the "No" box. If am wrong please let me know.
Ans: No is the right answer.
