My Tier 1 Entrepreneur Visa refused on bases of 245DD

Hi Guys

I had applied for for entrepreneur visa in November 2012 and was refused in march 2013. appeal was dismissed in lower tribunal in September. after that I launched a 2nd appeal in upper tribunal but withdrew it in December and submitted a new application within 28 days. I was asked to provide new bank statement and 46-SD if funds were invested. also I was invited for interview on 8th Januray 2015. I sent them all the papers which were stated in 46-SD.

by the end of januray I received a refusal. Grounds of objections are stated below.

1) in your interview you stated that you have an office, commercial unit based in ---- and you aslo stated in q17 of your interview that your company has a proper office. presumably this is the office you have had office build and maintenance of your office undertaken as described above. however we do not find this credible. you have not supplied any evidence of a lease or rental agreement. the address of your business on your website and all your contact details is ------. following a check of the address it appears that this is a residential street with no commercial buildings.

My Explanation on above objection.

yes that what I said in interview. I do have commercial property rented and lease agreement. lease was signed in May 2014 and my application was submitted in December 2013. address on the web is still my home address as I Didn't want to change it until the outcome of visa application. they asked me to provide bank statement and 46-SD. I did provide them all the documents which are stated in 46-SD. I was expecting they would ask me for lease evidence if they required but they didn't.

2. in your interview when asked how many other businesses exist in the local area that offers the same services to your business, you stated that there are so many that you can't count, and you also said that there are so many like 30-40 and computer repairs shop. you stated in the next question that you would attract customers with the prices and quality of services. and how you would deliver this services, and also that you have designed a tailored package to offer a complete package to the customers. there is not evidence that you tailored package would be any different to other business that advertise the same services.


Now my Question is I do not have right of appeal. only option is to go for JR. I need your guys help. is it worth going for JR? is my case strong enough for JR? on what Grounds I should contest my case?

Dear I am not a solicitor but both of above objections looks pretty standard, for point 1 if you can provide relevant documentation than great, and 2nd objection is silly, there are many business in the same area providing exactly the same services with similar or no offers at all and they are all surviving some of them are doing really good. Only difference is quality of service which makes the difference and you have already mentioned this. My suggestion would be to take it to JR, and consult with a good solicitor before taking any step.
