Tier 2 extension and speeding offence

Post by beatles » Sun Apr 13, 2014 10:09 pm

Hi all,

I came to work in the UK for 6 months now on Tier 2 General. Just yesterday when I drove on a (non-EU) foreign license, there were moments I thought I could exceed the speed limit in camera zones. A bit worry as my friend said it could be a problem for visa extension or ILR later on, so just make few assumptions for your advice here:

1. If it was caught by a speed camera, as far as I know, the procedure would require me to go to court as I hold foreign license. The fines and points should be then given by the court. Is my understanding correct?

2. Given 1, as I have to go to court, does it mean it is a conviction which requires spent time? If so, how long should I expect?

3. What is the current requirement for the spent time for speeding conviction for the purpose of ILR? Does it affect my Tier 2 extension in the next 2.5 years?

4. Let's say if the spent time required is 5 years, does it mean this time is on top of the normal time requirement for ILR? For example, if I am on Tier 2 and normally I can do ILR after 5 years, does it mean that I have to wait for 10 years or just 5 years since conviction?

5. I am the main applicant, so does the point 4 apply to my dependents?

I trust that these questions might be old but your updates on these things should be very useful for me as I am a bit anxious about my status.

Thanks,
BT
