Tier 2 Extension SOC Reference

Post by MaximusNostramus » Fri Aug 28, 2015 9:46 am

Hello forum readers and administrators,

Here I am after two years writing again on the forum. This time, I am planning 1 year ahead on my Tier 2 Extension application which I have to apply in July 2016.

Can you please advise me on the following please
-----------------------------------------------------------

I got my Initial Tier 2 Application granted in July 2013.

Now clearly, when I am applying for a Tier 2 General Extension, I will no longer be able to apply under the 'New Entrant' salary bracket underlined in the SOC of practice; instead, it should be 'experienced' salary bracket.

So here's my confusion:

See this link on UKVI page regarding reference guides on which SOC is applicable for applicants:
https://www.gov.uk/government/publicati ... ed-workers

You will see there are three documents which all have different salary ranges for my SOC code and thus a pain in the donkey or confusion pie to find out which salary is applicable to me.

Question:
Which one of these three guides should I be referring to when I was granted the initial Visa in July 2013?

Your help will be immensely appreciated.

Thank you

The one that says - from 6 April 2015, and appendix J.

Thank you for your response. I greatly appreciate it.

Could you please advise me that why it won't be the older document since you have advised to reference the latest one (6th April 2015).

I was under the impression that you are supposed to reference the document which is nearest to the date when the Initial Tier 2 Application was granted. I thought I was supposed to reference the Oct 2013 - 5 April 2014 guide.

Sorry to extend on my earlier question and take up your time.

Thank you in advance.

I cannot comment on where you got that impression from, but here's my reasoning:

The rate of pay for sponsored migrants is prescribed in the immigration rules - under Appendix J.
And the "current" Appendix J co-relates to "PBS codes of practice: skilled workers (from 6 April 2015)" only (from the list you referred to).
