Tier 1 Extension

Post by aaa123 » Thu Mar 17, 2011 11:11 am

Hi,

In case Tier 1 extension is rejected (due to missing supporting document with the application), for initial application made 28 days before original leave expires, then how long will one be allowed to make a fresh application without required to leave the UK?

Thanks

If a decision (refusal) is made on a valid in-time application when your current leave has expired, you will get a right to appeal. If you do not appeal and make a new (out-of-time) application, whether such an application will be considered or not is at UKBA's discretion. Even if it is considered and refused, you'll not get any right to appeal.

If a decision (refusal) is made on a valid in-time application when your current leave is yet to expire, you will not get the right to appeal. You may make a new application before your leave expires.

Will they reject application just because someone forgot to include a particular document?! Normally they ask for it don't they?!

Thanks

Consider yourself lucky if UKBA contacts you to provide the document(s) you "forgot" to send!
