Tier 2 General Change Sponsors (TUPE) Application Rejected

Post by ztsaries » Wed Sep 16, 2015 12:33 pm

To whom may be able to help:

I'm under Tier 2 General visa till the end of Feb 2016. I had been working for my old company A since 2014 as a marketing manager.

Recently, the old company A has been taken over by a new company B on 17th Aug 2015 (last month).

The new company B submitted the application and paid the application fee and posted the document to UKVI on 8th Sep 2015 (which is within 20 working days of the taken over) and was planning to transfer my CoS from the old company A to the new company B after the sponsor licence is granted.

However the new company B only just received the letter from UKVI on 15th Sep 2015 (which just past the 20 working days) saying they've rejected the application and refunded the application fee. And they haven't sent the new company back with all the support document yet.

The new company B is still happy to try to apply for the sponsorship licence again ASAP after UKTI returns all the support document.

However I have a few questions in terms what does the new company B need to do and what do I need to do:

1. Since it's passed 20 working days now, should the new company B still apply for the sponsor licence for the reason of TUPE? Or if the new company B should apply for a sponsor licence for hiring a new staff who has already got a tier 2 general visa?

2. My current tier 2 general won't expire till Feb 2016, but if the company B is granted a sponsor licence after the 2nd try, can they just take over my CoS via reporting in SMS? Or do they need to apply for a new CoS to assign to me?

3. In regarding to Curtailment, when will this happen? About when will I receive the notice?

Please advice! Much appreciated!

Tiffany

Further question:

4. I read on the GOV website saying if you have less than 6 months visa left then they won't curtail your visa to 60 days. So based on the taken over date which is 17th Aug, the rejection date which is 15th Sep, and my visa expire date is around 20th Feb (which I need to double check later), does that mean that I have less than 6 months visa left? Or does that mean I have more than 6 month left? Please advice.
