Tier 1 General Dependent - Peculiar Scenario PLEASE HELP

Post by Jacob123 » Mon May 09, 2011 12:48 am

Dear Senior Members,

Please help. I read most of the post but could not find answer to these question.

Background :
1. My company sponsored and I got a Tier 2 ICT visa. My family (wife and 2 kids) also got the dependent visa. Visa for all of us were stamped in India.
2. I traveled to UK alone on Tier 2 ICT Visa.
3. In the first week of April , I applied for a switch to Tier 1 General Visa. My biometric process is already completed on the 3rd week of April and I am waiting for a decision on Tier 1 General application.

Question:
1. Can my family travel to UK on the Tier 2 dependent visa while my application for Tier 1 general is under process? Their tier 2 dependent visa is valid till December 2011.
2. Can my family still travel to UK on tier 2 dependent visa after I get a positive result on my application for switch to Tier 1 General visa. Can they travel to UK and then we apply for the Tier 1 dependent visa for them here in the UK.
3. If I get the Tier 1 general visa, will my family’s tier 2 dependent visa will be disqualified/cancelled.

Many Thanks,
Jacob

Your application is under process so you are still holding your work permit visa and they can travel without any problem.

The other scenario is that you get T1G and your family travel after that. I think there would not be any problem but for the peace of mind you better contact UKBA inquiry line to get clarification on this.

They may be denied entry because of change of your circumstances (321A(1)).
Life isn't fair, but you can be!
